These are our Terms and Conditions of Membership to Mystic Charms.
Customers are agreeing to the following Terms and Conditions before
membership/purchase has commenced.

MEMBERS TERMS AND CONDITIONS

Please read these terms and conditions carefully as they govern the relationship
between you, and us and limit our liability to you. By accepting these terms and
conditions you are forming a contract with us and agreeing to the terms and
conditions that appear below. References to “you” and “your” are to you as an
individual. References to “us”, “our” and “we” are to Mystic Charms.

SUBSCRIPTION

1. You must be over 18 years of age to subscribe to this site.

2. On receipt of your membership fee you shall be entitled to use our services as
a member.

3. All Membership packages are non-refundable

4. You must provide accurate and complete Membership information and it is your
responsibility to update us of any changes (including your email address).

5. Each Membership is for the single individual named in your Membership
information.

6. Upon receipt of your Membership we shall issue you with a user ID and
password. You are responsible for the security and safety of your user ID and
password.

7 You are responsible for all use made of you user ID and password, including
preventing any unauthorised use of your user ID and password.

8. If you believe there has been any unauthorised use of your user ID, you must
notify us immediately by contacting us via email or telephone.

9. Unauthorised use or a breach of these terms and conditions will result in the
suspension of your membership until the matter is resolved to our satisfaction.

10. We reserve the right to make changes to any part of the services provided.
Any such changes will not, in our opinion, materially reduce the content or
functionality of the services.

11. We endeavour to remedy faults in the services including technical faults and
downtime of the website with minimal disruption.

12. In no event will we be liable for any loss or damage including without limitation,
indirect or consequential loss or damage, or any loss or damage whatsoever
arising from loss of data or profits arising out of, or in connection with, the use of
this website

13. The services we provide to you are for sale of products to your customers for
business, private, consumer and domestic purposes only.

14. Mystic Charms supplies products on a trade-only basis.

15. We will not supply products and reserve the right to cancel any order made by
you if we have reason to believe that your customer is operating as a drop
shipper.

16. Mystic Charms offers customers product ranges to promote via their website
or otherwise.

17. Images of Products on the Site are for illustrative purposes; actual Products
may differ from such images in size, shape or colour

18. Members are recognising that product ranges may be withdrawn at any time
without notice.

Credit Card Payments

We do not gather, store or process any credit card information, we use a 3rd
party financial services provided by PayPal. For more information about the credit

Purchasing, Shipping & Returns

1. If we cancel any order we shall offer a refund or credit to your account the price
paid by you.

2. We shall attempt to fulfill all orders in accordance with our terms and conditions.

3. It is your responsibility to ensure full payment is collected from your customer.
We recommend that you receive payment in full clear funds before ordering the
product from us.

4. If we are unable to supply the product ordered we will advise you to source the
product from another provider.

5. We will arrange for the Products to be delivered to the address for delivery
indicated on your Order

6. We put our return address label on the reverse of packages for security
reasons. No mention of Mystic Charms is made.

7. We aim to ship all products within 2-14 business days, but no longer than 21
business days. If a situation arises that will delay your order in any way we will
contact you by email.

8. The period stated within which your orders are dispatched is approximate

9. We shall have no liability to you for any delay in the delivery of products ordered
or any other matters to the extent that the delay is due to any event outside our
control.

10. Items that are Missing or lost in the post will be replaced ie replacement
product sent to your customer, after a period of 15 working days from posting for
UK deliveries and 30 working days for all other deliveries. See note 11 below.

11. For items lost or gone missing in the Post we will require a signed
confirmation form to be completed by the addressee of the parcel before we can
consider a refund or replacement.

12. We will do our best to correct errors and omissions as quickly as possible
after being notified of them

13. We advise the use of Recorded Delivery for orders over the value of £10.
Tracking numbers will be supplied for Recorded Delivery items only.

14. Any Parcels sent over the value of £10 by normal First Class Mail that do not
arrive at the customers address or go missing in the post will only be refunded or
replaced after confirmation of loss and after Royal Mail settlement for lost parcels.

15. We send all mail via Royal Mail First Class or Air Mail post. We use an online
service and no ‘proof of posting’ is required or obtained.

Our Guarantee

1. All goods purchased from Mystic Charms are covered by our 7 day satisfaction
guarantee. If for any reason you or your buyer wish to return any goods you must
contact us first.

2. A full refund shall be issued on receipt of the goods in new and complete
condition. We cannot accept returns if the item has been opened and
used/handled unless faulty. We reserve the right to deduct postage expenses.

3. You must return items within 7 days in a new and unused condition.

4. Where a product has a security seal or is shrink wrapped, a refund or exchange
will not be given if the seal is broken

5. We reserve the right to levy a 10% restocking fee for all returns. This does not
apply to broken or damaged items.

6. We will replace items that have manufacturers faults on receipt of the faulty
goods.

7. Refunds will only be offered where a replacement is unavailable. Refunds are in
the form of a credit to your account.

8. Herbs, Resins & Powders are non returnable.

General

1. Prices in our Members store are our dropshipping prices.

2. Prices may have to be altered up or down, including any alterations to the rate
of
value added tax.

3. We reserve the right to refuse to supply any individual or company.

4. All products are subject to availability

5. We accept all major credit and debit cards. The
card must be registered to the
account
address.

eCommerce Membership Terms and Conditions

1. Members who purchase the e Commerce option are agreeing to the following
conditions before proceeding:

2. The hosting of the website is with Mystic Charms Hosting Services.

3. As a service no refunds will be given to Members for membership, or the
purchase of eCommerce Membership

4. Members accept that on purchase of the eCommerce Membership the contract
will start immediately.

5. Hosting is a separate purchase and is payable seperately to the Mystic
Charms membership

6. The Hosting agreement is for a minimum of 12 months.

7. The eCommerce Membership includes registering a domain name of your
choice for one year, renewable annually.

8. The creation of a basic template with basic log/header and page style to the
members liking is included as standard with the eCommerce Membership.

9. Support in setting up the shopping cart with Paypal automated payment
method is included as standard with the eCommerce Membership.

10. Set up is not immediate and may take up to 10days during busy periods

11. The eCommerce Membership is purchased from Mystic Charms and the
member agrees to have the website created by our representative and hosted by
Mystic Charms Hosting Services

12. Members are also agreeing to our representative’s copyright link being
placed in a discreet area of the installed website.

13. Members purchasing the eCommerce Membership may use their own
domain name if they so wish. If using your own domain name, then redirecting the
name servers can take a few days to complete. We will assist with redirection.

14. The ecommerce store can not be installed as a 'module' through your own
hosting. Mystic Charms Hosting Services must be used.

15. We shall use our reasonable endeavours to make available to you at all times
the Server and the Services but we shall not, in any event, be liable for
interruptions of Service or down-time of the Server.

16. We shall have the right to suspend the Services at any time and for any
reason, generally without notice, but if such suspension lasts or is to last for more
than 7 days you will be notified of the reason.

17. The Services provided to you and your account with us cannot be transferred
or used by anyone other than you.

18. Support for your website is provided via support@mysticcharms.co.uk and via
the forum.

19. Support may be withdrawn if it is deemed to have been abused. You will be
advised by email in advance including reasons given.

Premium Rate Phone Lines Terms & Conditions

1. Premium Rate Psychic Phone Line and readers are provided by Inveroak.

2. Mystic Charms shall not be liable for any fault or interruption in the operation of
the Inveroak Network or in the availability or provision of services cause by fault or
interruption in services supplied.

3. All rights to your assigned telephone number remain vested in Inveroak.

4. You cannot sell, assign, or otherwise agree to transfer any rights in respect of
the telephone number.

5. The telephone number may be changed or decommissioned from time to time
by Inveroak for operation or technical reason or because Inveroak is requred to
do so by a supplier of in order to comply with regulatory requirements.

6. The telephone number is unique for use within the UK only and any international
call charge rates may apply to any use of the services by the end user outsite of
the territory.

7. Where your phone line fails to maintain a minimum use Inveroak my withdraw
such telephone number and terminate the agreement of that number with Mystic
Charms.

8. Members shall comply with and shall ensure that all End Users comply with, any
policy relating to the use of the telephone numbers notified to it by Inveroak from
time to time.

9. Members shall give Mystic Charms/ Inveroak as much written notice (email is
acceptable) prior to undertaking any marketing or other activities or events which
might reasonably be expected to materially increase the volume of calls
processed using the service.

Outpayments

1. Mystic Charms will be issued with an invoice before the end of the month
immediately following the month to which the invoice is stated to apply. Mystic
Charms undertakes to make all outpayments to members within 14 days of
receiving the invoice/payment from Inveroak.

2. A minimum revenue of £20 per phone line is required per month to qualify for
payouts.

Suspension
1. Mystic Charms may immediately interrupt, suspend or vary the availability or
provision of any service where;
A. Mystic Charms reasonably considers that the use of the service by the member
or end user may materially affect (1) the quality of the services or (2) the
performance, security or integrity of any part of the Network of (3) the network of
services of any third party (including any supplier) or

B. Such action is reasonably required for technical or operational reasons.

C. Mystic Charms or its Supplier is required to do so pursuant to Legislatation or
an order or an appropriate regulatory body.

D. Any services or facilities required by Mystic Charms Supplier in order properly
to provide the services are interrupted, suspended or varied by a supplier for any
reason.

Premium Rate Service Outpayments

1. The call rates payable from Mystic Charms to Members is £0.48 per minute on
each Premium Rate Number.

2. Traffic is calculated on a monthly basis beginning on 1st of each calendar
month.

3. Payment terms up to 50 days following end of month, assuming payment is
received from Inveroak.

4. The call charges are expressed in pence per call and the amounts payable will
be calculated on a per second basis, rounded up the the nearest second.

5. These payment provisions may be subject to amendment from time to time in
accordance with the relevant provisions of this agreement.

Compliance with Legislation

1. Mystic Charms will use it reasonable endeavours to provide members with
updates to the Acceptable Use Policy.

2. Members acknowledges that this Acceptable Use Policy is provided for
guidance purposes only and regardless of its contents, the members compliance
with this Acceptable Use Policy shall not diminish the members obligations to
take its own steps to ensure that it is familiar with all relevant Legislation that
apply to it.

3. Members will comply with all current and relevant guidance and codes of
practice issued by ICSTIS, the Financial Services Authority, Mobile Marketing
Association, the Information Commissioner and the Networks in respect of the
provision of the members services and the delivery of Premium Rate SMS.

4. No unsolicited message is sent to any End User.

5. Members must adhere to the various guidelines and regulatory requirements in
respect of the advertising, marketing and promotion of a Premium Rate Service
depending on the relevant media used to advertise, market or promote the
service and its intended and likely audience.

6. Members shall ensure that it clearly states the standard charge for access to its
services on all promotions.

7. Members accept sole responsibility for the quality and content of its
advertising, marketing and promotion of their services and ensure that they
comply with all applicable laws and regulations

ENTIRE AGREEMENT

These terms and conditions (as amended from time to time), together with the terms and conditions of use of the website (as amended from time to time) and the privacy policy (as amended from time to time), constitute the entire agreement between you and us. You should regularly check the terms and conditions of use of the website and the privacy policy for any updates and/or amendments.

GOVERNING LAW AND JURISDICTION

We shall endeavour to resolve any disagreements between you and us quickly and efficiently. The agreement between you and us shall be governed by the laws of England and Wales and you and we shall both submit to the exclusive jurisdiction of the courts of England and Wales.

Written confirmation of these terms and conditions can be sent to you by post within 7 working days, if requested. This rule is in full accordance with Trading Standards in the United Kingdom.
